Terms and Conditions
	This Policy was last modified on November 16, 2004 1. In General. Beginning 11/16/2004, C-Byte will be offering a Referral bonus to all C-Byte customers. By participating in the Referral Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. 2. C-Byte Referral Program. i. Eligibility. The Referral program is open to all C-Byte customers. ii. Persons Who May Be Referred. You must only refer C-Byte to individuals or businesses with whom you have a pre-existing personal or business relationship (a "Peer"). You must not submit yourself for this referral bonus. iii. No Spamming. We strictly forbid the sending of unsolicited email to numerous recipients ("spamming") and any C-Byte customer who spams others Internet users for referral bonuses will have his or her benefits immediately and permanently terminated. iv. Referral Program Maximum. You are limited to a maximum of $1000 USD of combined referral bonuses per month. v. Referral Program Requirements. For each Peer that you refer to C-Byte who purchases a new product or service under the Referral Program requirements below, we will pay you 5% or $5 which ever is greater via PayPal. To qalify for a Referral Bonus you must satisfy all of the following requirements: 1. You must register for the Referral Program at the Affiliate Center. You may register at, http://affiliate.c-byte.com/signup.php 2. Your Peer must use the Referral Link to purchase a new product or service. The Referral Link will be provided to you after you register at the Affiliate Center. 3. Your Peer must not return the new product for any reason. 4. All requirements must be satisfied before the Referral Program expires. vi. Referral Bonus Amount. The C-Byte Referral Bonus, 5% or $5 USD of all referred sales to be fulfilled via PayPal. viii. Maximum Referral Bonuses. You may only receive up to $1000 USD in combined Referral Bonuses per calendar month. ix. Method of Referral. To receive your Referral Bonus for referring a Peer, your Peer must purchase his or her C-Byte products or sales by going to the C-Byte sites through your Affiliate Center Link. Additional Terms and Conditions i. Referral Program Period. The Referral Program will be in force on November 12/2004. C-Byte reserves the right to discontinue the Referral Bonus program for any or all participants, for any reason, at any time for any duration at its sole discretion, and without notice. ii. Remedies for Your Noncompliance. If C-Byte determines in its sole discretion that you have not complied with these Terms and Conditions, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you under the program. iii. Limitation of Liability for C-Byte. TO THE FULLEST EXTENT PERMITTED AT LAW, NEITHER C-BYTE NOR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR OTHER REPRESENTATIVES WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS OFFER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. iv. Entire Agreement. These Terms and Conditions consitute the final, complete and exclusive statement of the terms of the agreement between you and C-Byte with respect to the Referral Bonus program and supersede all prior and contemporaneous understandings or agreements of the parties. v. Variation of the Terms and Conditions. These Terms and Conditions may be amended or modified by C-Byte in its sole discretion at any time. Any such amendments will be posted to this page, and it is your responsibility to review this page from time to time for such amendments. vi. Currency. Unless otherwise stated, all amounts in these Terms and Conditions are in U.S. Dollars. vii. Severability. If any provision of these Terms and Conditions is held to be illegal, unenforceable or invalid in whole in part for any reason, the validity and enforceability of the remaining provisions or portions of them will not be affected. viii. Governing Law. These Terms and Conditions will be governed by and interpreted, construed, and enforced in all respects in accordance with the laws of the Provice of Alberta, without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the exclusive personal jurisdiction of the provincial and federal courts within Canada, for the purposes of adjudicating any such action.
